Terms & Conditions — ITS Parking

These Terms & Conditions ("Terms") govern your use of the ITS Parking service (the "Service") provided by Infinite Training Systems ("ITS", "we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ITS Parking allows you to pay for parking at the ITS facility via a web app. Parking is offered at a flat rate of $15 per session unless otherwise posted. Parking is subject to availability and facility rules posted on site.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Account & Verification

To use the Service, you must provide a valid mobile phone number, vehicle license plate, and state. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for activity that occurs under your phone number.

4. Payment

Payment is due at the time of parking. The flat rate is $15 per session.
Payments are processed by a third-party payment processor. You agree to their terms in addition to these Terms.
All sales are final. Refunds are issued at our sole discretion, typically only for documented service errors or duplicate charges.

5. SMS Messaging Terms

By providing your mobile phone number and submitting a parking request, you expressly consent to receive transactional SMS messages from ITS Parking, including a one-time verification code and a payment receipt.

Message frequency: Per-transaction (typically 1–2 messages per parking session).
Message and data rates may apply. Check with your mobile carrier for details.
Opt-out: Reply STOP to any message to unsubscribe. After opting out, you may not be able to use the Service.
Help: Reply HELP for assistance, or contact us using the information below.
Carriers are not liable for delayed or undelivered messages.

We do not share, sell, or rent your mobile phone number or SMS opt-in data with any third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful or fraudulent purpose.
Submit false vehicle, payment, or contact information, or use another person's phone number without authorization.
Attempt to interfere with, disrupt, or gain unauthorized access to the Service or related systems.
Use automated means (bots, scrapers) to access the Service.

7. Parking Rules

Paying for parking does not guarantee a specific space. Vehicles must be parked in marked, legal spaces and comply with all posted signs and applicable laws. ITS is not responsible for theft, vandalism, damage to vehicles or contents, or any loss arising from use of the parking facility.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ITS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 30 DAYS BEFORE THE CLAIM AROSE.

10. Indemnification

You agree to indemnify and hold harmless ITS from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

11. Changes to the Service or Terms

We may modify or discontinue the Service at any time. We may also update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which the ITS facility is located, without regard to conflict-of-law principles.
